GENERAL TERMS AND CONDITIONS

Welcome to the website www.thejeanmaker.ca and its sub-domains, including the Online Shop operated by The Jean Maker, a legal entity incorporated in Sweden with company registration number 23-144323, located at #129, 255 New Port Drive (referred to as "The Jean Maker"). Orders in Germany are processed by a local subsidiary. Throughout this document, "we," "our," and "us" refer to The Jean Maker.

If you are under 18, you must obtain permission from your legal guardian to place an order in the Online Shop. By using the Online Shop and/or placing an order, you agree to abide by these general terms and conditions (referred to as the "General Terms and Conditions").
The Jean Maker reserves the right to make periodic amendments to these General Terms and Conditions. Any changes made by The Jean Maker will become effective no sooner than thirty (30) days after the revised General Terms and Conditions are made available in the Online Shop.

ORDERING AND ACCEPTANCE OF PURCHASES

Before finalizing your order, you can review your selection, verify the total price, and rectify any input errors. Please note that items in your shopping basket are not reserved, and availability may change before you complete your order. If an item becomes unavailable, we will promptly inform you via the e-mail address provided during the ordering process.

Upon submitting your order to the Online Shop, you will receive an order summary at the e-mail address provided. This order summary is an acknowledgment of receipt, not an order acceptance. Once your order has been processed, provided the items are available, and all information is complete, we will confirm your purchase to the e-mail address provided. This confirmation will include shipping information and tracking details.

Please ensure accurate billing and shipping information to avoid delays. We do not deliver to post office boxes, army post office addresses, or similar addresses. We reserve the right, at our discretion, to decline your order.

PRICES
​
General Information: We reserve the right to adjust prices for items in the Online Shop at any time without prior notice. Such changes will not affect items already purchased. If a pricing error is identified, The Jean Maker may cancel the order, in which case you will be notified via the e-mail address provided. If we cannot contact you, the order will be automatically cancelled. In the event of incorrect charges, you can place a new order at the correct price or cancel your order.

Unless stated otherwise, periodic sales and campaign offers are valid while supplies last and/or until the specified end date.

European Union (EU): All prices in the Online Shop include applicable Value Added Tax (VAT) but exclude delivery charges (see information on delivery charges below).

PAYMENT
​
We accept major credit and debit cards, including VISA, Mastercard, American Express, Maestro, and Discover, and local payment options such as Ideal, Swish, Sofort, and Vipps. Additionally, we accept payments through global online payment systems like Paypal (www.paypal.com) and Klarna (www.klarna.se), offering various payment methods.

Credit and Debit Cards: When placing your order, you can securely enter your payment details using a valid credit or debit card. The relevant amount will be temporarily reserved on your card but not debited until your item is dispatched. The transaction is processed by Adyen B.V. (https://www.adyen.com) to ensure secure payment compliance with PCI DSS v3.1 requirements. The Jean Maker does not store your card details; all information is encrypted and transmitted to Adyen B.V. via secure servers (SSL/HTTPS).

We may verify the validity and credit status of the card, as well as check if the provided address matches the card's data. Based on these checks, we reserve the right to decline orders. Ensure sufficient funds are available before placing your order, as some credit card companies may block foreign online purchases for security reasons.

PayPal / Klarna Account: We may verify the validity of your PayPal / Klarna account and check for adequate funds to cover your purchase. With PayPal, the applicable amount will be debited immediately upon placing your order. For Klarna, the amount will be reserved on your Klarna account but not debited until your package is dispatched.

DELIVERY
​
Our goal at The Jean Maker is to deliver your purchased items as swiftly as possible. If the items are in stock, the typical delivery time is 1-5 business days from the date of your purchase confirmation, depending on your chosen courier. Please note that this timeframe is calculated from the purchase confirmation until the item is available for pick-up or receipt.

In cases where an item is out of stock or other circumstances cause delays, the delivery time may be extended. Longer delivery times may also occur during sales and public holidays. Please note that The Jean Maker is not responsible for delays due to customs clearance processes.
All packages are dispatched via our logistics partners, and you will receive a notification via text message or regular mail when your package is ready for collection at your local service point or en route to the provided delivery address.

The Jean Maker insures each package in transit until it is delivered. In the event of a lost package, please get in touch with us promptly so we can initiate an investigation with our delivery service partner. This investigation may take up to ten (10) business days, after which we will inform you via e-mail.

UNCLAIMED PARCELS
​
If you fail to collect your purchased item from the designated service point, The Jean Maker will charge you for actual freight and return freight costs.
​
​
CANCELLATION
​
If you are a consumer within Section 13 BGB (German Civil Code), meaning you order a product for personal use rather than business or professional purposes, you have the legal right to cancel your agreement. This right allows you to cancel within fourteen (14) days without providing specific reasons.
​
To exercise your right of cancellation, notify us at The Jean Maker, #129, 255 Newport Drive, Port Moody, British Columbia, V3H5H1, Canada, or call us at +1-416-666-7514, or email us at info@thejeanmaker.ca. While you can use the provided sample form, it's not mandatory. The notification must be sent before the fourteen-day period expires.

If you cancel the agreement, we will refund all payments received, including shipping costs (excluding additional costs due to choosing a non-standard delivery method). This refund will be processed within fourteen (14) days of receiving your cancellation notice. We will use the original payment method unless otherwise agreed. We may withhold the refund until we receive the products or you provide evidence of their return, whichever comes first.

You must promptly send or hand over the products to us no later than fourteen (14) days after informing us of the cancellation. The deadline is met if you send the products before the fourteen-day period expires. Please complete the return form in your delivery and indicate the item you wish to return. If you've misplaced the return form, contact us at
info@thejeanmaker.ca. While we recommend returning items in their original packaging, it's not obligatory.

You're only responsible for any loss in value of the products if this loss is due to handling beyond what's necessary to ascertain their quality, features, and functioning.

EXCHANGES
​
Exchanges for different sizes and colours are possible, provided the items have the same price. These exchanges are subject to stock availability and are shipped to you free of charge. If you wish to exchange for an item of higher value, refer to your cancellation rights.

​
FAULTY ITEMS
​
If you receive a faulty item, contact The Jean Maker promptly. Report the fault within a reasonable time (within two (2) months of discovering it). If asked to return the item, send it to the address provided. Once received, we will assess the item. If it's deemed faulty, we will repair, replace, or refund it within thirty (30) days, including any return freight charges.
Please note that you bear the risk during return transportation, so we recommend using a delivery service that ensures the item's value.

CONTENT AND COLORS, ETC.
​
While we aim for accurate text, images, and pricing in the Online Shop, errors may occur. We cannot guarantee that colours will be faithful to life due to computer and monitor settings variations.

TECHNICAL REQUIREMENTS
​
Specific technical requirements may be necessary to place an order in the Online Shop using your device. This may include installing specific software or a standard web browser. Pop-up boxes or similar notifications will inform you if your device does not meet these requirements.
AVAILABILITY
​
While we strive for satisfactory operation of the Online Shop at all times, it is provided as is and with its current quality.

INVALIDITY
​
Suppose any provision of these General Terms and Conditions is void or invalid. In that case, the remaining provisions will remain in force, and the invalid provision may be amended to the extent it materially affects the rights or obligations of you or The Jean Maker.
FORCE MAJEURE

In cases of force majeure (such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters, or similar events), the contract between you and The Jean Maker may be partially or fully terminated by The Jean Maker.

GOVERNING LAW
​
Local laws govern these General Terms and Conditions without regard to conflict of law provisions. If the product is ordered for personal use (consumer agreement within Section 13 BGB), this choice of law applies as long as it doesn't deprive you, as the consumer, of any overriding consumer protection rules of your habitual residence.

For any issues with purchased items, contact our Customer Care Support. If you're dissatisfied and unable to resolve with our support, you can turn to your local Board for Consumer Disputes or the European Commission's online dispute resolution platform.
Please note that we do not undertake to participate in alternative dispute resolution procedures but will provide a final position on this matter if applicable.
